A transfer of equity involves changing the legal ownership of a property. This may include adding someone to the title, removing someone from the title or changing the shares in which the owners hold the property.

Transfers of equity commonly arise following relationship changes, marriage, separation, family arrangements, refinancing or other personal financial decisions. Although the property is not being sold on the open market, a transfer of equity is still a legal transaction and often requires the involvement of a solicitor.

If there is a mortgage secured against the property, the lender’s consent will usually be required before the transfer can take place and the lender may impose specific requirements that need to be satisfied.

Why a Transfer of Equity Matters

Changing ownership of a property affects important legal rights and responsibilities. It may impact mortgage liability, entitlement to future sale proceeds and decision-making in relation to the property.

It is important that all parties understand the arrangement and that the transfer is completed correctly. If appropriate procedures are not followed, issues can arise with mortgage lenders, Land Registry registration or the ownership structure itself.

Some transfers of equity also involve payments between the parties, family arrangements or wider financial considerations. Whilst conveyancing advice deals with the property transaction, separate financial, tax or family law advice may also be appropriate depending on the circumstances.

Understanding the Transfer of Equity Process

The process usually begins by confirming who currently owns the property, who will own it following completion and whether there is an existing mortgage secured against the property.

Your conveyancer will review the title, establish whether lender consent is required and prepare the necessary documentation. Once all requirements have been satisfied, the documents are signed and the transaction is completed.

If a remortgage is taking place at the same time, the transfer and mortgage arrangements must be coordinated carefully. Where an owner is being released from an existing mortgage, the lender’s approval will normally be required before the transfer can proceed.

Following completion, the change in ownership is registered at HM Land Registry.

Common Issues We Help Clients Navigate

Transfers of equity can involve additional considerations depending on the circumstances. Common issues include:

  • Lender consent being required before ownership can be changed.
  • One or more parties needing independent legal advice.
  • Tax, financial or other consequences outside the scope of conveyancing advice.
  • Deciding whether owners should hold the property as joint tenants or tenants in common.
  • Ensuring that Land Registry registration is completed correctly.
  • Transfers linked to separation, divorce or financial settlements.

Every transaction is different. Where questions or concerns arise, your conveyancer will explain the position clearly, discuss the options available and help ensure the transfer is completed correctly.

Helping Your Transfer Run Smoothly

It is helpful to be clear from the outset about the purpose of the transfer, whether any money is changing hands and whether the existing mortgage arrangements will be affected.

You should provide mortgage details and identification documents promptly and let your conveyancer know if any party has been advised to obtain independent legal advice.

If the transfer is connected to a separation, divorce or financial agreement, it is important to ensure that the conveyancing work is consistent with any family law advice, financial settlement or court order that may apply.
