Buying your first home is an exciting milestone and one of the biggest financial commitments many people will make. It is also likely to be your first experience of the conveyancing process and the legal steps involved in purchasing a property.
Terms such as searches, enquiries, mortgage conditions, exchange of contracts and completion can seem unfamiliar at first. Our role is to guide you through the process, explain what each stage means and help you make informed decisions along the way.
Why Conveyancing Matters
First-time buyers naturally have more questions because they have not been through the process before. You may need to understand the difference between a mortgage valuation and a survey, what property searches reveal, why source of funds evidence is required, what a gifted deposit involves and why exchange of contracts is such an important stage.
Buying a property involves more than securing a mortgage and agreeing a purchase price. The conveyancing process is designed to investigate the legal title, identify any issues affecting the property and satisfy your mortgage lender’s requirements before you become legally committed.
It is also important to understand the costs involved. In addition to your purchase price, there may be conveyancing fees, search fees, Land Registry fees, mortgage-related costs and, depending on the circumstances, Stamp Duty Land Tax and other third-party charges.
Understanding the Purchase Process
The process usually begins once your offer has been accepted. You will instruct a conveyancer, arrange your mortgage application, organise any survey you require and provide identification and source of funds information.
The seller’s solicitor will provide the contract papers and your conveyancer will review the legal title, obtain searches and raise any enquiries considered necessary. When the mortgage offer has been issued and the legal work is complete, your conveyancer will provide a detailed report explaining the property and any issues identified.
Once you are happy to proceed, you will sign the relevant documents and provide any deposit monies required. Exchange of contracts normally makes the transaction legally binding, while completion is the day the purchase funds are transferred and the keys can be released. See our Residential Conveyancing Process page for the full stages.
Common Issues We Help First-Time Buyers Navigate
First-time buyers often encounter questions or concerns during the transaction. Common issues include:
Issues can arise in any property transaction. Where they do, your conveyancer will explain the position clearly, answer any questions you may have and guide you through the options available.
Helping Your Purchase Run Smoothly
Do not be afraid to ask questions. No one expects a first-time buyer to understand every aspect of the conveyancing process, and part of your conveyancer’s role is to explain matters in plain English.
It is also helpful to keep copies of documents such as payslips, bank statements, savings records and any information relating to gifted deposits, as these may be required for source of funds checks and mortgage lender requirements.
If a family member is providing financial assistance towards your purchase, it is important to inform both your conveyancer and mortgage broker. Mortgage lenders will often require information about the person providing the funds and the source of those monies.
You should also avoid making significant changes to your finances during the transaction without first considering whether additional evidence may be required.
